Terms of Service

These Terms of Service ("Terms") govern your use of the Smalldays website at smalldays.app ("Site") and the Smalldays mobile application ("App"), collectively referred to as the "Service," operated by Smalldays ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Smalldays is a mobile application that helps parents capture and preserve childhood moments. The App allows you to record photos, videos, voice notes, and text entries on your device. Optionally, you may use our book printing service to create physical keepsake books from your captured moments.
2. Privacy and Data
Your privacy is fundamental to our Service. All moments you capture (photos, videos, voice notes, text) are stored locally on your device. We do not upload, sync, or access your content unless you explicitly choose to create a printed book. Our full privacy practices are described in our Privacy Policy.
3. Book Printing Service
When you choose to create a printed book, you consent to the temporary upload of selected photos and text to our servers for the purpose of book rendering and printing. By using the book printing service, you agree that:
- You own or have the right to use all content included in your book.
- Uploaded photos will be encrypted in transit (TLS 1.3) and at rest (AES-256).
- Uploaded photos will be permanently deleted within 48 hours of book rendering.
- Rendered book PDFs will be available for re-download for 30 days after delivery, then permanently deleted.
4. Subscriptions and Payments
Some features of the App require a paid subscription, managed through Apple's App Store. Subscription terms, pricing, and renewal policies are governed by Apple's terms. You can manage or cancel your subscription at any time through your device's Settings. Book purchases are separate one-time transactions processed through our payment provider (Stripe). We do not store your payment card information.
5. Waitlist
By joining our waitlist, you provide your email address voluntarily. We will use it solely to notify you about Smalldays launch updates. We will not sell, share, or use your email for any other purpose. You may request removal at any time by contacting hello@smalldays.app.
6. Acceptable Use
You agree not to use the Service to create, store, or distribute content that is illegal, harmful, or violates the rights of others. We reserve the right to refuse book printing orders that contain prohibited content.
7. Intellectual Property
You retain full ownership of all content you create using the App. We claim no rights to your photos, videos, text, or other content. The Smalldays name, logo, and Service design are our property and may not be used without permission.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We are not liable for any loss of data stored locally on your device. We strongly recommend maintaining your own backups. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use of the Service after changes constitutes acceptance.
